My husband and I live in PA. He has two children from his first marriage (ages 15 & 13). He has filed for bankruptcy due to credit card debit obtaining lawyers to fight his x in court for custody.
Situtation #1) He has a current custody order that states he is responsible for half of the childrens college education. Question: Can an order like that be overturned. This was originally made 8 years ago, and I read that in PA courts can obt not to force parents to be responsible for college.
Situation #2) His x finally (just this year, they have been divorced for 8 years) obtained a full-time job. She is now being laid off in September. The one child is in extracurricular activites and his x is asking for us to pay for more of it. He told her he couldn't afford it (he just got a second job to try to start cleaning up his bad debt) and she instead yelled and said that when she gets laid off she will take him back to domestic relations for more money. He makes an ok salary, but after car payments and regular living expenses, he doesn't have much left over. Question: Can she take him back to court, because she doesn't have a job again? Don't courts frown down on this type of behavior? It is taking advance of one parent because the other doesn't take the inititive.
Situation #3) Custody. He currently gets the children every other weekend. The order says "and other days jointly agreed upon" His x is usually good about letting them come over as much as they want. Question: Is it unreasonable to ask, especially since the kids are older for additional custody? At what age can the children make the decision who they want to live with?
Situation #4) Health insurance. His x used to cover the kids under her insurance(it was free to her under her part-time job). Then she was going to quit her part-time job once she got the full-time one. So she asked him to pick up the insurance, which he did over a year ago. Right now in his support order he is suppose to pay 60% of all medical visits not covered under insurance. Question: Would the 60/40 split now change because he now pays for the health insurance?
