I work in Kansas and my company has quickly gone downhill and become very unstable over the last 3 months. A lot of people have quit for various reasons. I am going to quit and I have 32 hours of vacation coming to me.
What is the best way to make sure I receive my vacation pay. Our handbook says 2 weeks notice must be given to ensure vacation pay but I am not going to give them 2 weeks notice.
Can I make up some lame excuse as a family medical emergency asking to take my vacation, then go to work one day after my vacation and then tell them I quit?
Also, where do I find the law for Kansas concerning my final paycheck? My company is notorious for not paying employees when they should.
I hope you understand what I'm trying to ask.
Thank you,
Dawter

Kansas has no law that requires the payment of vacation upon termination, therefore it's entirely up to your employer. If they are willing to pay out vacation to those employees who give and work two weeks notice, then those are the terms they set.

Can I make up some lame excuse as a family medical emergency asking to take my vacation, then go to work one day after my vacation and then tell them I quit? Sure, you can try that. That still doesn't mean it'll result in your receiving vacation pay though.

Also, where do I find the law for Kansas concerning my final paycheck? At the website for Kansas' Department of Labor: http://www.dol.ks.gov/index.html Kansas reg's require the employer pay final wages no later than the employee's next regular pay day after they terminate.
