Child Protective services pulled my boyfriends children from their mother and handed them over to him. We wer told we needed to file paperwork on Monday. Not sure what to file and what we will need to have a strong case. The courts have kept the children with the mother even after all of the order violations (contempt) CPS pulled the children because they felt the kids were in "extreme danger" What are the chances of the mother getting the kids back? It only took CPS about 3 1/2 weeks to make their decission to pull the children from her home.

What you file is up to you. Obvious options: petition for temporary custody, petition for permanent custody, petition for temporary custody pending drafting of a parenting agreement (goal for you to keep kids and mother to get better and custody tied to mother's progress on what her issue is). If you receive temporary custody, ask for support. You can go for permanent custody, but I do not think it would be granted based on what you are saying, so believe the temporary custody options would be best. The goal for now is to get the children out of foster care and into a safe place where proper care will be rendered. Another option is to ask for legal guardianship, but if the child is going to a parent, that should not be necessary.
