HI I WORKED AT A HOTEL IN KENTUCKY. I GET PAID TWICE A MONTH ON THE 5th AND 20th OF EACH MONTH. THEY SAY OVERTIME IS FROM SATURDAY THUR FRIDAY. I THOUGHT ANYTHING OVER 40 OR 80 HRS IS OVERTIME? OUR PAY PERIOD STARTS 1st thur the 15th and 16th thur THE END OF THE MONTH. ALSO I'VE BEEN THERE 30YRS. AND THEY HAVE BEEN PAYING HALF OF OUR VACATION PAY BEFORE JULY & THE OTHER HALF AFTER JULY FOR ABOUT 4YRS NOW. THE NEW GIRLS WHO WORK A YEAR GET 20HRS AND THE OTHER 20 AFTER JULY CAN THEY DO THIS?? I THINK SHE STARTED THIS BECAUSE SHE BROUGHT THE HOTEL IN JUNE. SHE HAS OWNED IT FOR 22YRS AND HAS GOTTEN MEAN ABOUT LITTLE THINGS.LIKE NO TV,ROOMS TO BE DONE IN 20MINS. WE SIT TO MUCH IN LAUNDRY :rolleyes:IF SHE WOULD COME IN WHEN WE'RE WORKING SHE WOULD KNOW WE JUST SAT DOWN. JUST THINGS TO MAKE US UPSET. :( THANKS SORRY FOR SO MUCH I JUST CAN'T BELIEVE WHAT SHE DOES AND KNOW THERE MORE AHEAD!!!

Hours worked over 40 hours in the workweek are to be paid as overtime for the great majority of non-exempt employees. In the case of your employer, hours worked over 40 from Saturday through Friday must be considered overtime, regardless of when the payday is scheduled.
As an example, an employee who works the following schedule is not due overtime for the first week and assuming that the person works no more than 40 in the 2nd week:
Week one:
Sunday: 8 hours
Monday: 8 hours
Tuesday: 8 hours
Wednesday: 8 hours
Friday: 8 hours
Saturday: 8 hours (part of week two)
If the workweek is Sunday through Saturday, the person is due 8 hours of overtime. Since the work week is Saturday through Friday, no overtime is due.
It is not illegal to pay different rates of vacation to different groups of employees (based on such factors as hire date) as long as the net effect of the difference cannot be construed as discrminatory against a particular protected class of employees. For example, if the people receiving less overtime are a minority than those receiving a greater amount of overtime, it may be seen as discriminatory.
