View Full Version : Cannot afford to pay demanded child support payment- CA

I am finalizing my divorce and custody settlement. The custodial parent is demanding child support pay and child care payment which is more than 50% of my disposable net income (after all state taxes,sss, medicare deductions).

They argue that they have used the CA support caluculator for this, but it is still to much. With requested payment, I wont be able to even provide a good existence for myself.

Aside from this I am the one picking up and bringing back the child from the custodial parent (San Diego). I live in LA, with current gas prices, I might not be even able to visit my child regularly.

Argue these points in court in front of the judge and propose what you can afford. Also, point up things the other parent can and should be paying for. You have to be left with subsistence.

i recently married my husb. has a daughter the take out 70% of his earnings and now since we are married they have included my in come into that including my son's ss from his father dying into it they call it (comunity property)They make it totally unliveable!!!

I can't believe that they can use your combined income to take child support. Have you checked with your child support office to make sure of this? If they can actually do this then maybe it is time to change the laws by first taking to your congressman and then the Govenor. I should be receiving child support but he seems to know all the loopholes and things are going so slow. He is $37,000 behind in child support. When he finally decides to work and child support is finally being witheld he changes jobs. I wish there were nice easy adult ways to deal with all this.
