My husbands ex is moving their children out of Indiana to another state. They just went to court 2 days ago to determine child support and visitation. She did not mention that she was moving in court (we did not know yet). Is it legal for her to move and if it is how do we do the visitation? Do we have to meet half way or does she have to bring them all the way. We dont know what to do. Please help.

If you think this is going to be a problem, get back into court asap to seek modification and further clarification of the custody arrangements since the intent to move out of state was not made known to the court or all parties at the hearing. I would go get this spelled out because it impacts visitation. It may be more feasible for the father to get the children for 1-2 months in the summers, then alternating holidays and a weekend a month or something like that, but if these things are not worked out for the situation, and you do not think the mother is going to cooperate- serve her before she moves and get back into court and hash it out.

She is planning on moving in 2 weeks. Should we call the prosecutors office or get our own lawyer that we cannot really afford. She is planning on meeting us half way each time we see the kids. But it is not real conveinent to do this every other weekend. We cant afford the gas to do it this often either. It is legal for her to do this?
