Hi-
My husbands ex wife has custody of their 3 kids. The younget one has lived with us for 3 years now and is 14. The wife is taking us back to court for more $. Since we are going back to court the 14 year old wants us to fight for custody of him. How will the child suppport be figured? Do we have a good chance of getting custody?

Her thinking is odd if you are paying support for three kids, one stays with you and you still pay her for caring for that child, and the other wants to leave and at age 14 the kid's wishes should be able to be considered by the court if Mom is not hearing it. I think you have a good chance at custody of the one you keep and the older 14yo if you have a stable, loving, supportive home for the kids. But to think she is going to get increased support when you are owed a decrease in support for having the younger kid for 3 years and possibly an offset credit for support paid the 3 years that you had the kid since you paid her support based on all 2 kids, and not 2. The standard is the best interest of the child, not the mother's bank account.
