I hope some one can help me. I am currently on maternity leave. Started Aug. 27th, I contacted my boss about coming back to work part time until sitter arrangements are made and until I am ready to turn him over all day without me being around. They told me that I could work Wed-Fri 9-5 until the week of Oct 18th then I would need to be back Full time. Since this is way before the 12 weeks is up, are they allowed to make me come back full time, with me working part time, before the 12 weeks?
Please Help!!!!!

Are you on FMLA or just a leave? There is a huge difference in terms of rights, etc. A description of FMLA, including eligibility requirements, may be found at: http://www.unlv.edu/Human_Resources/Benefits/fmlasum.html

Your doctor must document that your modified schedule is required for reasons associated with the birth of your child. Without that doctor's documentation, you are not complying with the FMLA requirements.

If you have the proper documentation and you are on FMLA, your employer cannot force you back to work early. You can file a complaint against your employer with the Department of Labor.
