Arizona - I was terminated from employment this past week, but I am still on disability. Is this illegal? I was in an accident back in February of this year and I am still on long-term disability. My doctor said I can return to work in the next week, but only to do light duty. On Friday, my manager called me and told me that "they no longer needed me and that my position was already filled by someone else" even after I told him that the doctor cleared me to return to light duty. Is there anything I can do about this? The company is well over 1000 plus employees.

It is legal, if that is the practice that they have with all persons who are out for a similar or lesser period of time. A larger employer may need to hold a job for up to 12 weeks, if the employer and the employer qualifies under the Family Medical Leave Act. However, since you have been out since February, you are long past the 12 week period. The only restriction is if they treat you differently than others because of your age, race, religion, national origin, disability, pregnancy status or gender.
