LConnell 09-27-2004, 07:41 PM California requires that people are paid overtime at time and a half for hours worked over 8 in a day and double time for hours worked over 12 in a day. On the 7th day, the first 8 hours are paid at time and a half. Any hours over eight are paid at double time. This premium pay is not required for people who work less than 30 hours in the week or less than 6 hours in any one day. (Keep in mind that federal law requires overtime for hours worked over 40 in a week.) As far as your question is concerned, the answer depends on what day the employer considers (and communicates) as the start of the work week. Some employers may have a work week that begins on Saturday at 12:01 am. Others may start the workweek on Sunday, etc. Every employer can set its own workweek, so long as it is consistent and it is not changing the week to avoid paying overtime.
