State of Missouri.

My carefree stepdaughter has wrecked some elses car, she was not living with me or my wife yet I am being sued because she was a minor. She was 17 and 9months. The owner did not give her permission to use the car but her daughter, my daughters friend did. The owner's insurance is taking me to court. I am I responsable far the minors actions or not.

The fact that she is a minor and does not live with you should not make a difference, unless she is on your insurance policy. Assuming she has her own policy, her insurance should cover this type of information.

Missouri requires all private passenger automobile insurance policies to cover a specific car and these drivers:


The person named in the policy.
The spouse or any other family member living in the same household.
Any other person who has permission to drive the car.
Personal auto insurance policies can specifically exclude named drivers from coverage including family members who live in the home. Some policies may only provide the minimum liability limits (25/50/10) for other drivers not in your household, who drive your car, even when your limits are higher.

Your stepdaughter may not have had permission from the car's owner, but if she did get permission from the daughter (who I assume is listed on the policy), you'll want to write down names, dates, times, anything you can think of.

You may want to contact the state office, if at all possible, since Missouri is a tort state. "The Department of Insurance has no authority to act as a court of law to resolve questions of fact. Be sure that, when you contact the department’s office, you are able to support any allegation of a violation of law" (http://insurance.mo.gov/consumer/auto/autobuy/complaint.htm).

I would also contact an attorney, as well as your own insurance company (if she was listed on your policy).
