Correct me if I'm wrong.

Wasen't there a new regulation that stated that if there was a Federal Holiday at the beginning of the week or during the week, that subsequent days following through to Saturday at Midnight, the compensation would be straight pay without overtime?

In one way it would be better for the employer and not the employee...

Straighten me out or provide me with a resource to go to.

There has been no change to the law that I am aware of. The law continues to state that overtime is due only after 40 hours WORKED, not 40 hours PAID. So if there has been a holiday during the week, regardless of whether it is Federal, state, or local, the time you may be paid for the holiday does not count towards overtime.

Ex. Monday - 8 hours holiday pay
Tuesday - 8 hours
Wednesday - 10 hours
Thursday - 8 hours
Friday 10 hours

In this scenario, all the time would be at straight time, because the employee did not WORK 40 hours, even though he is paid for 44 hours.

Ex. Monday 8 hours holiday pay
Tuesday - 12 hours
Wednesday - 12 hours
Thursday - 10 hours
Friday - 10 hours

In this case, the employee would get 40 hours of straight time, 8 hours of holiday time (paid at straight time) and four hours of overtime, since they WORKED 44 hours.
