View Full Version : Need Custody help in Texas/Louisiana

MY divorce was granted in Louisiana 4 years ago, at the time custody was granted to both parents. I moved to Texas 3 years ago and my daughter has been living with me since last fall full time. She is visiting over the summer in La, but my ex is now claiming that he has papers that show he has legal custody. I know not of these papers, is there a way he can weasel custody with out my knowledge? He cliams the judge in La signed the papers I was in Texas. I thought they had to make a reasonable attempt to serve me. I received no summons and i have been living in the same place for 2 years. Also I visit back home in La at least once ever 2 months plus my family does live in the same town with him. Please advise, thank you! :confused:

Call the court in LA to make sure he is not making this up. If he is not, then file with the court a request to restore the previous custody order with you having primary physical custody because you were never served and you have been in the same place in TX over 2 years and you have family there local and the father knows your address, and also state that there have been no change in circumstances to warrant a change in the custody so that you should remain the parent with primary physical custody. You can do this yourself, or hire an attorney and ask the court to have him to pay attorney fees for it since he did this without consenting you or serving you where there were no grounds that existed for modification and there had been no change in circumstances.
