Hello,
My name is christina and I feel that I was fired for the wrong reasons. I am from Georgia and worked for a hopsital.
There was a inncident that came up on 09/04/2004. A patient came in to the ER in Labor (said she felt like she needed to push) and the nurse was not going to even check here. The nurse said that we did not do OB's here and told the patient she would have to go somewhere else. Any way I asked the nurse if she need to check the patient first, well she did and we had to ship her out by ambulance to another hospital (our PA went with her). Well the nurse wrote me up and the administrator of the hospital asked to speak to me that following Wednesday. Her i gave her the truth on what happened I did not deny that any of what the nurse was true. Well i got suppened for 2 weeks with NO PAY. On the tird week 9/21/04 , I was fired because i told a nurse at another hospital that i was suspened (she also worked for the same hospital that i was employed at too). Well she went back and told them that I said ( that I was suspened) and they fired me for that!
IS that wrong? and is that against the HIPPA law also?

While it is difficult to give an opinion as to whether your termination was legal or not, it does sound like there is a possibility that you were terminated because of the way you may have handled the situation, rather than by being fired for assisting a patient, based on the information that you gave.

If that is true, you don't have any recourse, other than any internal appeal process your company may have, such as contacting the HR Department of the hospital. On the other hand, if you were not terminated for the process but that you alerted the nurse to a potential dangerous situation, there you may be covered by laws protecting the medical rights of patient. I am not an expert in that regard. You may wish to contact the US Department of Labor to ask them the same question. Their website is at http://www.dol.gov/

While it may have been harsh and "unfair" it was not illegal to terminate you; unfortunately employees can be terminated for just about ANY reason as long as it is not illegal and discriminatory in race, age, sex, etc.

As far as HIPPA, from what I have read, that is about continuation of Health Coverage; how does that apply here? Sorry, but I am missing that part.
