My wife is currently working for a company that pays her hourly (more than minimum wage) plus commission. Sales are made and commissions are paid out the following month. She recently made a sale that she was paid on, but the goods that the company shipped to her client were rejected and sent back without being paid for. As a result, she is in the hole and will have to achieve that profit again to pay back the commission she was paid.
She has been looking for a job and is close to getting one. The sales manager for the company sits next to her and they were talking about the deep hole she is in and how she will get out of it. The question I have stems from his next statement. He said to her out of nowhere "you know if you go get another job these guys will bill you for it. You know how they are." 'It' of course being the back commission. There is nothing in her employment agreement mentioning anything about leaving while in the hole.
What I am wondering is if they are legally entitled to 'bill' her for this or if they are just blowing hot air? Any help would be greatly appreciated! Also, if she leaves, can they withhold her hourly wage, saying it is going to pay this commission back?
