What is the law for lunch breaks in Kentucky? I work about 30 minutes from my job so I can't run home for lunch so I hardly ever take a lunch break. I have lunch delivered and eat at my desk. It takes maybe 15 minutes out of my day and I usually work while I eat. Maybe once every 2 weeks, I take an hour for lunch and do my shopping. Anyway, my employer subtracts one full hour from my check for each day to account for my lunch break whether I take it or not. He says that we are given an hour for lunch and if we don't take advantage of it it is our own fault. Is this legal?

If you are given a one hour lunch break, you should take it. If your employer allows you to work during your lunch, the FLSA says that you are to be paid. The employer must pay you for all hours worked. See the U.S. DOL website, www.dol.gov.
