I work for a medical clinic, the pay days are every other Monday. The time goes in each Monday. I only worked 12 hrs the first week of the pay period (due to my childs illness) and I worked 51 hrs the second week of my 2 week pay period. The payroll person (the doctors wife) said that she didn't have to pay me overtime for my time over forty-hours on that 2nd week. Can you tell me if this is correct or not????

If you were in just about any other field, the answer would be no, they couldn't. However, in some areas of the health care field, an employer may pay ot based on 80 hours in two weeks, rather than 40 hours in one. You should check with the DOL to see if this is the case for medical clinics.

That is true. Healthcare is exempt from many overtime pay rules because of the nature of the work and its shift nature and long hours. Also, there may be a consideration about employer policy as viewing a pay period as two weeks and not one week. Since you are paid every two weeks, there is an arugment to be made for that. You can always call the state department of labor to see, but healthcare also gets many OSHA and occupational work and safety exemptions also.
