I have been working for a furniture store for the past year.I have been on straight commision only,I recently quit this position to take another position & they have refused to pay me my commisions due on a $103K in sales.My commission due is roughly $4K.The store manager has gone into the comuter system and removed my name from the program data base,fortunately I made copies of my open sales,he has also given my sales commissions to another salesperson.I have not received a penny since I left and they have cut off communication with me.What are my alternatives and what rights do I have in this situation. Options as I see them
- file a labor claim thru the FL Dept of Labor
- sue for unpaid wages/commissions due
- file a FLSA claim
As a practical matter, you will likely have to sue for unpaid wages/commissions.

I would say no...however, you can check around. Florida is of not help on this. They have minimal labor laws, with only laws protecting youth. Therefore, the only law that comes into play is federal law. Federal law does not require the payment of commissions, as long you made a rate of minimum wage or higher per hour and that there wasn't an agreement to the contrary.
