View Full Version : Emotinal distress & bodily injury at workplace on an elderly employee

My mother n law is about 65 years old she works in a jewlery dept of a large corporation (not sure if I should say the name or not). She just recently about 2 weeks ago came to me in tears her Manager of their dept hit her on the side of the head with the telephone. She also said that she has numerously yelled at her and wave her hands in her face as though she is going to slap her. She has been very stressed out about it. We are located in Montana. She said she has went to the managers assistant manager and has expressed how she has been mistreated, nothing was done about it, she went to higher management when the manager hit her in the head, Management lady told her that she was concerned and would have a talk with this person, and even said that they wont hire and train anyone to replace her cause she is the best they ever have trained. So my mother n law asked security to see if she could find it on the security videos, well she found it on the video & was shocked by what she had seen. Well, The manager was given a verbal warning and my mother n law still has to work with her. Nothing happened to her and weare outraged . What type of lawyer can we go to and how can we fight such a big corporation or would it be both the employer and the manager? Please help where do we go from here?

What you have is more along the lines of an assault charge rather than labor law. It is a very sticky situation but you must assure the safety of your mother in law.

You can talk about filing assault charges on the manager who hit her, but I don't know the laws on that.

Has she filed in writing a description of what happened to place in her employee file?

If this guy is such a hothead, and he has been "warned" it could go either way: this could be enough to scare him into civility or --- he may try and get your mother in law fired.

It might not be a bad idea to think of employment elsewhere is that is feasible, in case this happens again and she needs to get the police involved.
