View Full Version : Campus Police refuses to file assualt charges

a friend of mine attends University of California Riverside and lives in an apartment across the school. the individual that lives beneath him apparently continued to tell my friend and his housemates made a lot of noise. eventually one night he came up at three in the morning while nothing was going on and told them to "shut the **** up." my friend started to talk back and the next day the guy stalked him and waited outside his class and kicked his face, he knocking out four of his teeth and broke his nose.

the local police say its out of their local jurisdiction so they won't do anything
the campus police didn't press charges or do anything

apparently he does have an extensive background varying from assualt to theft... but yet the school won't kick this guy out (even though he's been kicked out of UCSD before for the same reasons) or do anything.

the lawyers that they have consulted say that there's nothing they can do.

can my friend get a restraining order? make the school take disciplinary action? file assualt charges? anything?

You can get a restraining order, but is it effective if he is underneath you. I guess you can say that he is to not come to your door and should stay from your zone of personal security. But it is hard to enforce given you all are in the same building. I am assuming a police report was made after the injury that could support such a request. You can try. You also should make a formal complaint with the university in writing, whether they act or not as support for the restraining order. Also, maybe contact the prosecutor's office to see if someone might prosecute for assault. I am assuming there are medical records of the injuries and maybe a witness.
