Michigan

Employer said that he over paid me as far back as ten years and now wants to take it back in the form of a two week check.

What I want to know is can he go back that far or can he only go back 6 months?

10 years! I would say that is way too late. However, you can not file a claim proactively. Instead, if your employer should withhold your pay, you can file a claim against them with the state. Their website may be found at: http://www.michigan.gov/cis/0,1607,7-154-27673_32352---,00.html

Hi,
Its me again. I went to the state of Michigan site like you told me. I got the info. But then at work they told me those laws don't apply to me because I work for a school system. I drive a school bus and that makes me a government worker.

What gives? The government plays by a different set of laws?

Is this true?

sign me just a little confussed.

Yes, public employers are exempt from several of the requirements of FLSA.
