Yes, Over40 not far from 50 either. Last Friday was terminated by a company for not completing work on time during probation. At least 3 days after probation period. WHen i was hired they did not inform me of other office responsibilities required for this job and promised to give me what i asked for in 3 months. THey added on more entry level tasks that is time consuming and gave me the lame excuse as listed above. I asked about my job description and they told me undecided, and that they already promised me more $$s in 3 months time. 3 weeks ago I took on even more responsibilites as one of the worker was on medical leave. Mangement had a meeting and told me my new responsibilities are critical, and priorities. I knew the new duties will require majority of my 8 hrs work day, in order to do a good job, I immediately request for relief of other entry level tasks, they told me I could rotate w/the new hires.

I have volunteed on some projects and they assumed that is also my job now and I am suppoesed to fill in every department whenever an employee is absent. I noticed they have been hiring much younger workers regularly and recently for same titles/positions in my department and in the company yet they are released of the entry level duties I had. When I told the new hires that's their turn they refused and their supervisor refused plus gave me a lecture. I continue to ask management repeatedly if they can get the new hires to share the entry level duties, three weeks passed and now they said they have not decided. I was constantly questioned on the status of my newly added responsibilities. Obviously, I could not complete everyone else job plus my exisitng assignments within 9-5 and I am not staying after, since they do not pay overtime and they did not keep their promises to relief me.

Everyone acted as if they are my boss, made unreasonable demands and rude comments, complained to management frequently as if I was the super doormat. Not to mention the managers and employees are rude and yelling at me more often than others as if I was stupid and inferior. I asked other employees why I was yelled at in an open office so often and the new hires do not get the same treatment. They said I was old, and the others were young.

A day before I was fired a new young hire came on board in my department and she was told her position was same as mine, and undecided. I voiced my opinion to a manager that it is not right to have me take on the new jobs yet not released me of the other tasks (which is not my job) that could be shared between 4 new hires. That afternoon I was fired.

In my exit interview they told me that I did not stay after work to complete the tasks, that I complain too much, that other people w/the company 2-3years are still doing the same jobs and never complain. They said in case you are wondering why you have the so-and-so duties and others dont, they had already told me before that I was in a training period and would be offered many other different types of work to perform. All the new hires have definitions of their job, while i was there longer and still have no set job description. Also, there was another higher level position just become available which I fit perfectly due to experience and skill, they never offered to me, not only they offered it to the new hire that's less qualified,instead, they fire me.

I am getting the impression it's age discrimination, what do you think? I appreciate your feedbacks before I call the EEOC, HFEC etc tomorrow.

What you describe as discrimination may just be case of unfairness (or perception, thereof). If the same person(s) who hired you have since decided to terminate you, it would be difficult to prove age discrimination. Theoretically, they wouldn't have hired you and then, in turn, fired you, if their intention was not to have someone over 40 working for them. You can read more about discrimination at eeoc.gov.
