i was terminated this morning because my supervisor states it as " insubordination" becasue i told here i was not working overtime. this is what happened my supervisor in march hands out this list of "extra hours available" at the end of each month, never did she say the hours were mandatory and does not state this on this list. well on friday may 20th she comes to me and says " do you work overtime for the money or because i ask you too?" well i then tell her i am not able to do this overtime this month and i am not sure about next month, you see i just had a baby. this upset her and never during our conversation did she say this overtime is mandatory. well the days have gone by with no response from her about the situation and just today she fires me. i received no oral or written actions. i have been at this job for 5years never being written up and all my reviews are outstanding. do i have a case? can she do what she did to me? oh, also i wasn't the only one who did not show up for overtime that weekend but i was the only one fired.

First, let me say I am sorry to hear what happened to you.

As far as being terminated for not working overtime, yes, that can be done legally, as long as you are not discriminated against.

If you feel you have, visit www.eeoc.gov to see if you have a case.

Best wishes.
