If fbi sent ur completed name check result to bcis on Nov 5th 2003, then
why bcis told u on nov 20th 2003 that name check was not done?



how many days it takes bcis to recieve the completed name check results
from bcis ??? even if fbi mailed them by cheapest ups service 5 day
ground service we would call it fast.

The FBi does the fingerprint checking.....the name check is done by
somebody else..Who.. No idea.

Name check is done by the FBI; at least this is what they have

been saying to the lawyers and the public.

It takes at least 2 weeks for the name check results to show up on
USCIS' MF computer system. FBI sends the results electronically to
USCIS, where the data is formatted and loaded into the MF computer
system. It takes another week or 10 days for someone at USCIS to
review the results. So we are looking at at least 3 weeks from the
time the results are sent to USCIS to the time these results are
reviewed.

Except if there is a name hit and there is a need to find

relevent hard copies. Also I understand that there is also

a CIA name check.

First time on this forum i am going to share + progress ..



i sent Fbi my name check inquiry form on dec 3 2003 and i just got reply
as follows....



This is refrence to fax recieved on Dec 3 2003. Your clearance was
completed and sent to USCIS on Dec 8 2003.



OK now question....



my interview was in July 2003 almost 6 months ago and according to this
e mail looks like USCIS never fwd my fbi name check request???? because
it just got done on 8th dec 2003. and i sent them on 3 dec 2003 so only
5 days it was cleared.



what u guys think of this situation plz let me know. should i take this
as positive responce and be happy that my case is moving finally.?????

It is positive. Nothing to worry about. I think you name check/record search
request was pending with FBI after USCIS sent it to FBI. Based on iformation
you provided, FBI appears to have completed it on Dec 8. The fact that the
name check was completed late does not mean that it was never submitted to
the FBI by USCIS. I believe USCIS did submit the request, it was just
pending with FBI. For unknown reason, FBI has not been completing name check
for certain individuals until that person contacts FBI for the status. They
just keep that request pending. These persons appear to have muslim name or
born in a muslim country. At this time I don't know enough about this, but
this is my observation.

Further, you can ask FBI (same office that send you fax) to tell you when
FBI received the name check request from USCIS. Anyway, you should contact
USCIS after 3 weeks from Dec 8, 2003 to see if the results of name check has
been posted to your case file.

For your peace of mind what you can do is to send an FOIPA (Freedom of
Information Act and Privacy Act request to the FBI Headquarters and to the
field office having jurisdiction to the area where you live (two separate
FOIPA requests) asking to furnish you with copies of your own records, if
any. If there is no record, you will get a response indicating "no record".
The purpose of "name search" for N-400 is to find out if the applicant has
ever been of investigatory interest to the FBI. FBI maintains such records
in their system called CRS (Central Record System). The "name search" is
basically a search against the indices to the CRS.

CIA is not involved in a any record checks for N400 applicants.

had my name check done on november 17 2003 FBI sent me letter stating
tha name check was completed on 11 17 2003 and sent back to USCIS , i'm
sill waiting



i made a privacy act request an received confirmation that name check
was negative "no records" of me in the FBI CRS DATA SYSTEM

the writ of mandamus was filled with the federal district court by the
end of november and it has been assigned a to a federal judge



i received last week the summons stamped from the district court clerk
and i did mail them by way of certified mail to the defendants this
monday , they will have 30 day from the day they receive the summons to
make a formal answer with the court



i'm keeping my finger crossed

Go to the civil section and ask to see past cases; they are

classified by agancies. See .... vs BCIS, and Ridge

Of course it'different in different states. Which state are

you at?

i did a serach on there web site and could not find any case or similar
case i used different keyword (mandamus , naturalization ,BCIS , USCIS ,
naturalizatio etc...) , but i got nothing the only case si found where
for habeus corpus for immigrant that are detained or waiting to be
depported it seems that there are no mandamus action case , i dont
know if no one in Boston ever filled a mandamus action in a
naturalization delay

maybe i'm the first one , if yoy find any similar case in diferent state
let me know

or transcript of a civil case they will ask you a case number, when i
when to the boston web site i did some search for mandamus case but to
no avail i could'nt find any



i may may go to different web site for the federal district court in
other state , ex: virginia, ny , etc... and do some search and see if i
can find any similar case where a mandamus wasi filled because of a long
delay in the adjudication for a naturalization application etc....



if any one else on this board know any hints or info regarding mandamus
action against USCIS please shre your comments
