I have a friend who came on 1999 or 2000 (I am not certain) as a foreign
exchange student in high school.
A few months before graduation he suffered a brain stroke.
Of course his family came here (at the moment they told them to just come
pick up his cadaver since he was most likely going to die). They all came on
tourist visas, and he of course was on f1. He surprisignly recovered from
the stroke and is able to do a lot of stuff now, he is even atending college
and is on a new f1. His mother decided to stay taking care of her son
whenever this all happened back in 1999 or 2000, since it was better for his
treatment to be here in the US rather than a third world country. With the
help of a friend lawyer they were getting his mother a six month extension
every six months so that she could be legal.
On the last extension the INS (bcis or whatever their name is now) replied
and said they are declining the extension because by taking care of her son
(driving him to school and back, cooking and cleaning after him) she is
taking away a job from an American. They have of course filed an apeal to
this, I dont know many details about it.
My question is, what could they do? they dont have much money and would be
nearly impossible for the son to stay here on his own, so if the mom has to
leave, then the son would leave as well, and his therapy would probably not
be as helpful in tehir home country, nor will there be a good emergency
response in case something bad was to happen to him again.
Any siggestions are welcome.
