A salesperson working for a builder died before all earned commissions could be paid. The builder has now refused to pay the second half of the commissions stating they were unearned. Are there any Laws protecting these commissions or the deceased?

The deceased's estate will have to take legal action againt the company to obtain the earned, unpaid commissions. So whoever is the estate administrator or representative will either bring a wage claim or court action for payment of the deceased's wages.

I am the Personal Representative to this salespersons estate and sole heir. A salesperson left this company and sued for thier commissions and lost, but it was thier choice to leave. Before I spend the monies from the estate I am trying to find out if there are laws protecting her commissions.
