View Full Version : HELP! Labor certification canceled - attorney fault

O my god! :((((((((( I just call DOL they said LCA application was canceled
2 years ago after a year of processing because attorney did not proceed with
advertisement after applying, or fail to advertise correctly.... And she was
telling me all this years until now that it was all allright! ... I am
loosing ground under my feet.... Last paper from my attorney (I faxed it
today to DOL as they requested, she(attorney) faxed it to my employer this
September ) is RIR labor advertisement - She starting it all over again
after 2 years from the date of cancellation! :o PLEASE! suggest what to do,
I'm lost.....

Now you know why your attorney would not answer you. Sound like a serious
complaint against her. Not to mention possible negligence law suit against
her.

I would DEMAND a refund and quickly find another attorney.

I started looking for another attorney today, it is very hard, one attorney
estimated 9000 to take over my case, I think because she have to mess with
screwed up paperwork from my present attorney. And I understand nobody want
to touch this case. I'm getting the feeling that I will have to do it
myself..... I still can not believe that legitimate US attorney can do
things like this. She is out of her office this week, when she will be back
I will demand an explanation and I will see where I can go from there....
I'm posting another new topic message - I wonder if I still eligible to
adjust my status like this, I'm adjusting it under section 245(i).

Possibly you can get her to pay the new atorney or else talk about going to
court over negligence
and state bar complaint
