Hello,
My brother is in the USA with OPT
approval, but found no job so far.
His OPT expires in Feb 04.

He already has 2 BS degrees and
is of latin american citizenship.

I have a couple of questions.

1. My father has a US greencard and can apply
for citizenship early next year. Assuming, it
takes him a year to get citizenship, would he
able to petition for my brother (over 21) ?
Can my brother stay legally while his petition
is in process?

2. If my brother starts graduate school, can
he work part time outside campus or only in
campus?

3. Other than an H-1 visa or an F-1 visa are
there any other visa categories that would allow
him to stay in USA with legal status?
