status based on marriage to a U.S. citizen?
The answer is generally yes.
2) Can he/she look for a job first and let the employer prepare the H1B visa for him/her?
If the question is this:
Can a person who has violated temporary status obtain H-1B status?
The answer is yes, provided the person and the job offer qualify for H-1B
classification, and the person leaves the U.S. after the H-1B petition has
been approved, gets an H-1B visa stamp in his passport, and re-enters in
H-1B status.
