My question is for Colorado.
Recently the company I work for filed Chapter 11. Since then our insurance benefits have been terminated by the insurance company for non payment of premium. What we have been told is that the company did not pay for the premiums in June filed Chapter 11 then paid for July's premiums. supposedly the insurance company put the money on June's premiums then they termed our policies for July since they did not receive the premiums. The company has been taking a percentage of the premiums out of our check and continue to do so. They tell us they are working on the problem. I have to go to the doctor today and they have told me that I will have to pay for the visit out of pocket. I called my employer and they have told me to go ahead and pay it then submit it to the insurance when they straighten things out. Can they do this or is the company liable for all bills since they are taking the money out of checks. I also have an FSA for medical and I have not been able to activate this because there is no money yet they are taking the money out of my check.

If you have any ideas of what I should do I would appreciate it.

If your employer is misdirecting employee group health premium and/or FSA contributions into the general assets of the company, they are in big trouble. I suggest you contact the federal Department of Labor immediately: 202-693-4650
