My child is in Louisisna and her mom is not doing right by her and not wanting her to go to the private school that I am PAYING FOR. Just received joint custody and I feel she would be better off with me her father who has been there since day one. :)

Take her back to court....start documenting everything that involves her. Your conversations, the presence of the child when you get her, etc. I'm in the same boat and I've started building my case, and it'll take time but if you can prove her to be (not necessarily) unfit, you will have a much better outcome once you go back to court and fight for custody of your child.

I think you need to figure out why a private school is better as I do not think this is an issue that is adequate enough to get a change in custody. Public school has its benefits in that a kid may deal with kids of all different social and ethnic groups, and that can be a good thing. I think this is you are upset, but if you feel strongly that the private school is in the child's best interest, you can take it up with the court. BUt maybe there is another way to expose the child to what you want that is not private school too.

I read today-because I'm in the middle of a custody battle myself:
CustodyModifications:
Must show by a "perponderance of evidence" that a change of circumstances warrants the modification, even if it could reasonably be concluded that a child would benefit from JT custody. Evidence needs to be "clear and convincing" not, presumptive or in other words, falible by contrary evidence.
Hope that helps to get headed down the right path with building a solid case.
