View Full Version : Traffic-ticket for littering in emergency in NJ

Hello,

Just need some advice for a ticket I got for littering from parked
car. Here's my case, my toddler in his car-seat spilled some
crushed-ice drink. He started crying so I stopped on the side road
parking spot. It was completly dark and unlighted street. I cleaned
up the ice with a tissue and through it on the side. All this while
there was a cop in his car silently observing but not visible to me as
it was too dark.

My baby was still crying and I started to drive again. Just than he
switched on his head light and before I knew it he started his siren
and Stopped me.

I explain to him but he just gave me a ticket anyway for littering of
$200.
.. I intend to contest. Can I win this one myself or should I hire a
lawyer ? Any advice would be appreaciated.

Of course he gave it to you anyway. You left your stuff on the side of the
road. I doubt that you'd win it by yourself or with a lawyer. Next time
you need to pick up your trash and take it with you after you finish
cleaning up.

Are you trying to say that the law regarding littering does not apply if
your child spills something in your car? What has constituted "emergency"?

You should have started moving the car before you threw something out
the window. Or put the litter on the top of your car and slowly
accelerate away, making it look like it didn't come from your car.

On what grounds are you going to contest? Because he was "silently
observing"? Because he was "not visible" to you? Because he switched on the
overheads and siren? Does the law allow you to litter if it is night and
you are in a "completly dark and unlited area"?

I was wondering the same thing. If they win the case, they should right a
book on how to beat any criminal charge. I can hear defendants now
........... "There is no way the officer saw me speeding, Your Honor. It
was dark and I didn't have my lights on."

That's what I got from his post at first. But I *think* he said he
picked up the ice with a napkin and threw "it" out into the street -
meaning the napkin as well.

I know NJ is pretty backwards but I didn't realize the punishment for
littering was that severe...

If you threw the tissue on the side of the road, you deserve the ticket.
If you only threw the crushed ice drink out, then you don't seserve the ticket.
