I'm not even sure if this is the best place to post this, but I live in a townhouse, that is managed by a Home Owners Assocition. I have had menay problems with them and the mangement company in the past. This week however takes the cake. They are doing random pruning of bushes on the property, but here is the thing. The Landscapers only maintain shrubs put in by the property, not those installed by homeowners. It is allowed by the way to deviate from the original landscape design, but they will tell you that they will not maintain it. So what has happened is that they have cut about 1 and 1/2 foot off of the top of my Juniper bush and almost all of another one. It looks just awful, and per the pruning instrucitons for the plant this is not a proper way to prune. You can remove taller branches but you are not instructed to cut off the entire top. Now they are saying that the Turf personale did not know that the bushes were not part of the original bushes so they are not reponsible for mutilating my bushes. What should I do.

If you wanted you could sue them. If I were you, I'd just write a nasty letter demanding $300 to replace the bushes and letting them know that if it happens again you are suing them.

I tend to rant a little. I have my letter all written up. I wrote it to the Board of Directors, who are also homeowners. According to the girl at the management company she has spoken to them and they agree with her. She then got pretty curt and told me not to contact her email again and to mail any information in the future. I am seriously considering spending 70 dollars and filing a judgement against them. That you for your understanding, Ill try not to pull all of my hair out.

You should be able to sue in small claims court. The fee would be very low and the process is simple. That will wake them up :).

You can sek resolution thru the homeowners association process, but as a practical matter, I think you are just out the money.
