When my ex and I married, we lived the Dallas area. We moved to Burleson, after we had our son, to get closer to the 'slower' pace of life. After about a year in Burleson, he decided he wanted to start a company in East Texas and we moved there, off of Lake Palestine. Our son was 1 year old.
Three years later, we separated. The ex moved to White Settlement, over 3 hours away, and we stayed in the same home. I filed for divorce, and we stayed on temporary orders for 2 years. Our son remained with me.
Within that 2 year time span, I moved to Corsicana after landing a job in Dallas. We weren't there 4 months and we moved to Hallsville. That move was short, short lived, (like 2 months) and we moved back to Corsicana and my job back in Dallas. During this time, we quickly obtained our divorce before it was to fall off the books and have to be refiled. We didn't elect the restriction to keep me in Smith County nor Corsicana. There is no restriction regarding moving in our order. Pick up and drop off is at my residence.
Not 3 months later, the job I was at did a HUGE layoff; me included. With my resume plastered throughout the DFW and East Texas area, I was offered a job Gregg County and moved back to East Texas.
Note: residency never changed from Smith County until we lived in Gregg for 6 months in August 2001. (Gregg is a contiguous county to Smith). We've lived here now for over 4 years and the court jurisdiction has been moved to Gregg from Smith.
My ex moved to White Settlement, at the time of our separation, and stayed there for 2 years. Then he moved to Grapevine, and now Euless. During all this time, he's been picking and dropping off our son at my home -- as our order states. Note: Throughout these last 4 years, the ex has considered moving to Hawaii and now is considering Houston, however, is postponing the move until he sees what the court says.
See now he has decided, seven years later, to try and force me to meet him half way .. on the premise that I am the one who moved away.
He moved 4 counties away from our primary place of residence. I moved one county (contiguous to our primary residence). The total difference in distance from our primary residence and where I live right now is 12 miles further.
Anyone have any ideas on how to handle this?
