I am from New Jersey and I am having a custody problem.

I am 24 years old and I have a two year old daughter. About seven months ago me and her father split up. It was a pretty nasty break up. We argued constantly and we finally ended it when there was a domestic violence case. I tried to put a restraining order on him but the judge denied it. We went without talking for about a month but then decided that we should get along for our childs sake but that didn't last very long. We went back to court and we were granted joint custody but he has residing. Now that I have decided to see someone else he refuses to let me take my daughter overnight. I don't know if that is allowed but I don't want to cause problems because he has a short temper and can go off at any time. What can I do

have you talked to a lawyer?i dont see how he can keep you from keeping your daughter overnite if you have joint custody.it depends on what your agreement was in the custody suit.i would say contact your lawyer ASAP.good luck!

Go to the court and seek a contempt order, or next time he refuses call the police and seek to enforce visitation. Give the police a copy of the order, and let him argue with them. If he does, and goes to jail or is arrested, you have grounds to go seek custody of the child. And you also have proof to support a compempt motion to show that he is not following the court's order.

He told me that the cops won't help me and don't want to get envolved. He has his ways of working around the law. Just don't know what to do
