View Full Version : Terminating Child Support in Illinois

Does anyone know if terminating a child support order is possible?

I haven't received support in almost a year, my son's dad sees him once a week and buys him stuff and pays for things he needs. His income is below poverty level and he can just barely afford to feed himself. I thought that if I terminated child support and we made our own arrangements it would de-stress the both of us about this new law that we have in Illinois where dead-beat parents can go to jail if support is not paid. He's a great dad and we were both young when I had my son. I'd rather have him around for my son than have to take my son to visit him in jail.



Any help would be wonderful!

I'm not up on Ill. Law but I know in nebraska you can sign a waiver for support freeing him of the responsibility.

thanks for the response, surprisingly i cant find anything on it except the legal termination age.

Well what you could do is when he pays the child support both of you have record that he paid and then you can just give him the money back. That way if his situation improves then you can start keeping more child support. It sounds like you two get along great and you both are fantastic to remember that it is the children that matter.

We send my husbands child support payments to:
Illinois State Disbursement Unit
PO Box 5400
Carol Stream, IL 60197-5400

Also, when my children turned 18, my ex-husband had to go to court and file a form (he found it at the court house) to request stop payments. We did it ourselves, without any lawyers and no additional cost. Hope this helps

Go file papers with the court to terminate child support and explain to the court that private arrangements have been made with the father, and that you both desire to maintain a private arrangement. You may need to spell out that private arrangement for the court to approve, and ask them to issue an order terminating the child support matter in the court. That should be the end of it.
If you cannot hire an attorney to do this, you can do it yourself. draft a form yourself or go to a site like uslegalforms.com and look at a termination of child support form for IL and adapt for your own use.
