View Full Version : Can an employer take wages out w/o documentation

My DH is currently in a pay dispute with his company for them paying him incorrectly. They say he was overpaid in his 2nd paycheck (but wasn't actually) and now are saying that they are planning to take the *extra* money back out of the next 4 paychecks. There is nothing in writing other than DH's pay rate (which they are refusing to honor and making up a totally different salary). Can they do this? If they do, what are the options available to us?

I'm not 100% certain and I'm not where I can easily look it up, but I believe Maryland is one of the states where an employer cannot take a deduction without a signed authorization from the employee.

He should contact the MD DOL.

Thanks for the reply. Hopefully the MD DOL will actually call us back. He has had a call into them for 3days and no one has called us back.

Dol is usually very slow. if you can e-mail, that helps. Keep calling. They get backed up. Something you can do in the meantime is look into the law for record-keeping/personell files. There may be something there that requires deductions from pay,etc. Then see if you are allowed a copy of your file, or at least to examen it.
