NOTICE TO EMPLOYEES
Under the HAWAII WAGE AND HOUR LAW
(Chapter 387, Hawaii Revised Statutes, and Chapter 12-20, Hawaii Administrative Rules)
MINIMUM WAGE
$6.25 per hour
effective January 1, 2003
TIP CREDIT – Under certain conditions, “tipped employees” may be paid up to twenty-five cents less per hour.

OVERTIME
At least one and one-half times your regular rate of pay for all hours over 40 per workweek.

Minimum wage and overtime standards under the Hawaii Wage and Hour Law also apply to employment covered by the federal wage and hour law (Fair Labor Standards Act) whenever these standards are higher than those under the federal law. The law also requires employers to maintain time records and prescribes methods for computing overtime pay.

The Hawaii Wage and Hour Law exempts certain types of employment from minimum wage and overtime.

ENFORCEMENT: The Department of Labor and Industrial Relations may recover back wages, either administratively or through court action, for employees who have been underpaid.
