View Full Version : Ovetime law with Hourly employee in SC

I am an hourly employee in South Carolina. I work right around 35 to 40 hours per week currently. When the summer begins I will bringing in around 50+.
1. Is there a law in SC that says the employer is required to pay overtime?
2. If so what type of compensation?

My co-worker said that she was going to bring in 56 hours this week and when asked about overtime, she was told that "Since she was an hourly employee, she did not get any type of overtime pay other than her regular hourly wage."

3. Is this legal?
4. I keep hearing about EXEMPT and NON-EXEMPT. We are just regular hourly people. Houw would we know what we are? and what is the difference.

The overtime premium rate is one and one-half times the employee's regular rate, unless otherwise specified. SEE FSLA info.
