In researching the DLSE Manual, I believe that sick time (classified on a pay stub as "paid time off") could be consitituted as "vaccation time" under 15.1.12 and under Labor Code Section 227. (There are no guidelines from employer on using the sick time.) Am I right? wrong??
Recently being terminated/laid off in California, I am trying to be paid for time still owed to me. My "final" paycheck stub shows I still have 19 hours of unused vacation time and 40 hours of unused sick time on the books. I am definately going to push for the 19 vacation hours however am unsure if I can legally push for the 40 hours of unused paid sick time.
Suggestions?
