View Full Version : Is paid sick time considered "vacation time" ?

In researching the DLSE Manual, I believe that sick time (classified on a pay stub as "paid time off") could be consitituted as "vaccation time" under 15.1.12 and under Labor Code Section 227. (There are no guidelines from employer on using the sick time.) Am I right? wrong?? :confused:

Recently being terminated/laid off in California, I am trying to be paid for time still owed to me. My "final" paycheck stub shows I still have 19 hours of unused vacation time and 40 hours of unused sick time on the books. I am definately going to push for the 19 vacation hours however am unsure if I can legally push for the 40 hours of unused paid sick time.

Suggestions?

You are wrong. Sick time is provided for a specific reason by its very name. Vacation is provided for you to use any way you want.

You can try to push for it, but I have very little hope of your success.
