I work for a family owned company of 12 employees. My work schedule is typically 2 weeks on the road, 1 week in the shop and 1 week off a month. My question(s) are 1) we are required to clock in when we are at the shop and can be docked hourly (treated as hourly), but when we are on the road, we work 10-12 hour days (also possibly drive on weekends) and are expected to drive long distances between jobs and treated as salried, is that legal? 2) I am being expected to drive 120 miles (each way from the shop in a company vehicle-480 miles in 2 days plus work a full day) for a job that is 2 days long so my employer does not have to pay per diem, is that legal?

Are you working for an interstate trucking company? If so, there are exceptions to wage and hour law for its employees. You can read about it at: http://www.dol.gov/esa/regs/compliance/whd/whdfs19.htm

There are so many exceptions that it would be difficult to know whether it is legal or not. You can read about some of the exceptions at: http://www.dol.gov/esa/fact-sheets-index.htm

For example, there is an exception for employees working for a retail or service establishment who are paid commissions. That is described at: http://www.dol.gov/esa/regs/compliance/whd/whdfs20.htm

Those exceptions do not apply, our commissions are a small percentage of our annual pay. I do not understand how we can be salaried while on the road, but hourly while at the home office. I also wanted to know if it is legal to descriminate aginst single people for employment, advertising publicly they only hire married people :confused:

It is not illegal to discrminate on the basis of marital status in Kentucky.
