My husband was hired as a salaried manager for a small but very profitable company in Florida. When he became ill with pneumonia 3 months ago, he missed 6 1/2 days of work. Because of this, he lost a full week of vacation, and had to make up four of those days for his employer. In replacement of his vacation, he was allowed to have one paid day off in addition to his regular days off so that he could have his first weekend off since last August.
I know this is complicated, but wanted to give some details to aid in any advice given.
Our question is, is it legal for him (the employer) to pro-rate days when they miss time, but not get paid overtime when they work overtime? My husband agreed to work 45 hours each week for a set salaried amount. He typically works 49 or 50, and receives nothing for the extra time.

Also, they were promised health insurance when they started, and some employees have been there 6 months and still have no health insurance.

Check the employee handbook. If he is salaried, there is no pay for overtime. I do not know the sick leave policy, so sometimes if the sick leave is used up, vacation time is used. As for the health insurance, not enough information to know.

1.6 days are given for sick days each month, and the days do not accumulate. The employees have never been given an employee handbook, and there is no HR department to inquire. What are typical sick days given, or is it all according to what each employer has listed in the handbook?
