My fiance' works seasonal for the city of Coshocton, mowing the cemetary. He was told that he could work Saturdays but he would not get paid overtime. Can they do that because he is a seasonal worker? He does work 40 hrs a week.
Overtime pay is only required for hours worked in excess of 40 hours, therefore if your fiance' works 40 hours he is not entitled to overtime pay. Additionally, extra pay for work performed on weekends or nights is an issue that is strictly between the employer and employee or the employee's representative. The Fair Labor Standards Act does not mandate extra pay for nights, weekends, or double time unless it exceeds 40 hours.
