We work as contractors in the IT field in MO, we work the night shift and then are forced to work OT on the weekends on day shift several weekends a month? It is very hard to work our normal 5 days of nights and then be off one night, come in work a day, and then come in the next day and work our normal night shift again.

Also, another point to consider is we have about 30 people total who work on our helpdesk (it is divided into 4 different areas) but only some of those 30 people (about 6) are being forced to work the weekend overtime??

Thanks for any help you may have.

Hi, hockey mom. I too have a kid (a teenage son) who was really into hockey. He has switched now to lacrosse...which is better for me due to the cost and the increased flexibility. (The kids can play lacrosse anywhere.)

In any case, the situation you describe would not be described as discrimination, so long as the reason why people are treated differently is not due to reasons such as their age, race, religion, gender, national origin, disability, etc.

Let me know if you have additional questions.

Yes, my 8th grader just started playing high school hockey, he has been playing club hockey since he was 6. Scary when some of the guys drive themselves there.

Could I claim sexual discrimination as the we only people who work nights and are being forced to these weekend day shift--we are both female?? I hate to do that but this is getting horrible, I would really like to have 2 days off with my family.

Thanks,

Michele

Your earlier message said 6 people are working the alternative shifts while your last message mentioned "both". Are only women required to work the alternative shifts? Are there many exceptions?

There needs to be a pattern of different treatment of men vs. women in order for it to be considered discrimination.

Also, are you contractors or are you employees? As contractors, you have much less rights than an employee.

Let me know if you have any other questions.

6 of us are forced to work the weekend shifts, but only 2 of us (both women) are forced to work day weekend shift when our normal shift is nights. We both work 10 pm to 7 am (her Sun-Thur and me Mon-Fri).

We are contractors, this is the first time I have ever been a contractor and it is not something I think I would want to do again.

I don't believe that you have a case but you should check with the EEOC to be sure. Take care.
