I haven't posted here in a while so I hope someone can help me resolve
this issue.
My K3 husband with whom I was having a pretty rocky marriage [i do love
him] brought his 2 sons with K-4 [because of me] living now in Utah. My
husband told me he was going to visit his sons in Utah. He arrived this
morning and said he has found a job that would pay him good money but he
has to live there for a few weeks. I sensed this trip was our last
goodbye. He and his sons - one of them with SS number as well as my
husband will be making money to send to their relatives overseas. My
husband offered to send me money every week once he starts working but I
know this is his way of keeping me from proceeding with legalization of
his and his kids status [20 and 21 yrs old]. I'm terribly hurt and want
to get a divorce ASAP. My question is - once the divorce is final -
does Immigration cancel my husbands SS and his son's or do they get away
with using me to get here until their permit expires in March 2006.
This is not a vindictive action - I just think I have to abide by the
Immigration rules that say that once marriage is dissolved - benefits
acquired through US citizen come to an end. Or am I wrong? I have only
processed work permits and not the removal of permanent condition. Did
I do the right thing?
Sorry about being so lengthy. I know this is the only place I can get
some answers.

with the divorce. Be absolutely certain to cover yourself financially.



I'm sure someone will correct me if I'm wrong, but if the I-485 is not
submitted, his status should expire when his K-3 expires whether you're
divorced or not. From the moment you start divorce proceedings,
immigration is his problem and it's up to him to work his passage. If
his visa is good until March 2006... well, so be it. Don't worry about
it. Move on and chalk this up as a valuable lesson learned. Good luck.

I think it's very unfair for him and his kids to continue using their
work permit obtained through me even after the divorce. They think they
have other alternatives as far as legalizing their status via marriage
or job contract later on. I wanted those benefits to terminate before
their expiration date but if there's nothing I can do then let that be
it.
