View Full Version : KY - Prevailing wage overtime

The situation is such: we have several employees who had their 40 hrs in on Thursday. They were asked to come in on Friday and work (it just happened to be on a prevailing wage job). They worked 8 hrs. Is there any law, regulation or statute that states overtime MUST be applied to the prevailing wage job and they are entitled to the prevailing wage overtime pay? Or can we as the employer choose what job to apply the overtime to? Any input is greatly appreciated! Thanks!

Do you mean the prevailing wage under a Kentucky contract? You can read about the overtime rate for Kentucky prevailing wages at: http://www.labor.ky.gov/esat/pwage.htm#c Based upon what I read, the base rate must be the prevailing wage.
