View Full Version : Small Claims Court or Wage Claim ?

In March of 2005 my son started working overnight for a major retailer in CO, at that time he was to recieve a raise for a shift differential. This raise and several hours of overtime that he has worked each week has never shown up on his paychecks. After being told for several weeks that the back wages would be on the next check and to date it has not been paid; we sought legal advice. He was told that he can either go to Small Claims Court or file a wage claim with the Colorado Dept. of Labor for mediation. Which is his best option for getting what he is owed?

I would first file the wage claim since it won't cost you and they do look out for the interest of the employee and if you don't get results; try small claims court; or do both.
