I work for an agency that provides assistance with daily activities for the elderly, usually in their home but also attend to residents in any type of medical or residencial facility as an independent third party. We do not provide any medical care.

What are the laws governing overtime?

I also recently stopped working for a similar agency which stopped payment on my last two paychecks. I had been told that another caregiver would be replacing me with my current client as I wasn't performing adquately for his needs. I'm sure I was set up by the 'replacement' who is also very tight with the owner/manager. I was not told I was fired but after our conversation I realized this was not someone I wanted to work for. I was never called for another assignment and I didn't request one, so there wasn't a clear cut termination of services. How can I collect my final pay?

First, concerning the pay due, I realize I’m taking this thread off topic, and should I take this question to another thread?

I hope it will be as easy as filing a claim because I imagine this woman will try to claim I am not due my full wage, stating lack of performance. This then would entail providing proof, which on her part may be easy. The notes written during our shifts are where the other caregiver, again who's real tight with the 'boss', was able to discredit me, along with establishing an advisory relationship with the client's wife, where again she could make her look superior-me inferior.

My only recourse would be to involve the man's wife and a co-worker, which can jeopardize her job. I hate to put any more stress on the wife as she is totally stressed emotionally not only with her husbands condition, and the many twists and turns it has gone through these past six months, but also personal illness and family crisis’s. This might also put her in a dilemma because she depends on this agency 24/7, in their home.

I also have questions about whether this agency is operating according to regulations for this type of work. Where might I find a good source of information?

I did some calling, got the 'here's someone elses # who can help' until I came full circle and also looked on the net without getting any clear cut answers that could bring about charges. When I was enquiring I didn't come out and say I thought an agency wasn't following regulations but rather just inquiring about what they were in order to be informed. My next step was to act as if I was starting an agency and ask what do I need to know.

I want to settle my wages before taking her on for any violations but would like to have the information in case it will come in handy.
