I am currently paying on a spousal support award and my x-wife has indicated that she may want to obtain a wage garnishment against me. The payments I make are always timely and sent as to the instructions in the settlement. I have also never been late or short in any of the payments. Is it true that she can just up and decide to do this without any justification after over a year of timely payments?

If she files for wage garnishment with the court, you receive notice. You need to tell the court that you pay on-time already and bring receipts to prove it, and state you do not feel wage garnishmnet is proper since the current arrangement is being honored.

Thank you for your information. This case has been riddled with baseless threats, and knowing that we are not at her mercy is heartening.
