I am considering starting a small lawn care business in Minnesota. Will I have to pay overtime for seasonal employees that only work in the spring, summer and fall? If so, is overtime paid after 40 or 48 hours a week. Does the size of the company (gross sales) matter when determining whether a company has to pay overtime?

I appreciate any help you can give me.

Overtime must be paid by all employers because of the very broad criteria that the US Department of Labor utilizes to define its employees. There are several exceptions to these rules for seasonal operators. You can read about them at: http://www.dol.gov/esa/regs/compliance/whd/whdfs18.htm
